Builders Warehouse Online Pty Ltd (“we”, “us”, “our”) operates this online store. We supply goods only — no in-person services or physical retail operations are provided.

2. Trade Accounts (Silver / Gold / Platinum)

Our Trade Accounts are discount-only accounts designed for approved Australian businesses.
They are not credit accounts, and no credit, delayed payment, or account terms are offered. All purchases must be paid in full at checkout before goods are dispatched.

• Discounts apply only when logged into your trade account.

• Trade benefits are non-transferable and may be varied or withdrawn at our discretion.

• Deliveries beyond metropolitan Melbourne incur quoted freight.

• Members who do not meet spend thresholds may be moved to a lower tier.

3. Eligibility & Registration

• Trade accounts are available to approved Australian businesses only.

• A valid ABN must be provided at registration.

• We may verify, approve, or revoke accounts at any time.

• Misuse (false information, resale of benefits, shared logins, or abuse of discount privileges) may result in account suspension or termination.

4. Pricing & Payment

• All prices are in Australian Dollars (AUD) and include GST unless stated otherwise.

• We reserve the right to correct pricing or description errors before dispatch.

• Payment must be made in full at checkout unless otherwise agreed in writing.

• We do not offer credit, payment terms, or trade finance — orders are processed only after full payment is received and cleared.

• Stock will not be allocated or dispatched until payment is confirmed.

5. Shipping & Delivery

• Delivery timeframes are estimates only.

• Risk passes to you on delivery to the nominated address; title passes upon full payment.

• You must ensure safe access for deliveries. Redelivery/wait fees may apply.

• Free-shipping offers apply only as described in the Trade Account table above.

• Deliveries are to Australian addresses only; we do not offer local pickup.

6. Products (Goods)

• We aim to display product images and colours as accurately as possible, but variations may occur due to manufacturing batches (especially tiles) and screen settings.
• Limited or clearance items may sell out without notice.

• We may restrict quantities or cancel orders at our discretion.

7. Returns & Australian Consumer Law

• Your rights are protected by the Competition and Consumer Act 2010 (Cth) and the Australian Consumer Law (ACL).

• You are entitled to a replacement or refund for a major failure and to have goods repaired or replaced for minor faults.

• Nothing in these Terms excludes or limits your ACL rights.

• For change-of-mind or incorrect-order returns, please refer to our Returns Policy (conditions and restocking fees may apply).

8. Privacy

Personal information is collected and handled in accordance with our Privacy Policy, compliant with the Australian Privacy Principles (APPs).

9. Intellectual Property

All content, images, and logos on the website belong to Builders Warehouse Online or our suppliers. You may not copy, modify, or distribute our content without written permission.

10. Limitation of Liability

To the maximum extent permitted by law, our liability for any breach of a non-excludable guarantee is limited, at our option, to:

• the replacement or resupply of goods, or

• payment of the cost of replacing or resupplying the goods.

We are not liable for indirect or consequential loss except where required by law.

11. Force Majeure

We are not responsible for delays or failures caused by events beyond our reasonable control (e.g., weather, transport disruptions, supplier shortages).

12. Governing Law

These Terms are governed by the laws of Victoria, Australia. Any disputes shall be heard in Victorian courts or tribunals.
